When a person is arrested for DUI they usually receive two separate tickets for DUI. The first ticket is based upon the police officer’s observations of you and the second is for providing a breath test that results in a reading greater than 0.08.
11-501(a)1: is for having blood alcohol level greater than 0.08.
11-501(a)2: is based upon the police officer’s observations that he believes you were “in actual physical control of a motor vehicle.”
If you are found guilty or plead guilty one of the charges will be dismissed.
