My clients often ask if their auto insurance provider will find out that they are charged with Driving Under the Influence of Alcohol. The short answer is No, however in some cases the answer is Yes.
First, your auto insurance company will not be aware that you were arrested for DUI, (unless you tell them – – so don’t tell them). Once the DUI case is over, if the case is dismissed (Motion to Quash) or you receive Court Supervision, your insurance company will have no way of knowing about the arrest. However, if you are convicted of the DUI, the conviction will go onto your public Illinois Driver’s Abstract (record) and your insurance company will learn of the DUI and your rate will most likely greatly increase.
Additionally, if you have the Statutory Summary Suspension rescinded (dismissed) it will further ensure that your auto insurance company will not learn of your DUI arrest and therefore not raise your rates based upon your arrest.
