Last Thursday, I appeared in DuPage County for my client who was charged with Retail Theft. He was accused of taking protein powder without paying for the item.
What really happened is that my client paid $50.00, (the price with tax was $49.95) and left without a receipt. The store clerk pocketed the money. The next day the video showed that my client handed a bill to the clerk but the video was not clear enough to show how much. The clerk now admitted that my client only paid $20.00 and that he stole the money.
At court the clerk plead guilty to theft. The prosecutor wanted my client to admit that he underpaid for the item. I told him that I wanted a trial because my client paid full price. I also mentioned that the only witness the prosecutor had to testify against my client just plead guilty to stealing my client’s money.
The case was dismissed.
Now, my client has a very good case against the store, the clerk and the police department for his wrongful arrest.
