Class 1 Felony:
I have a charge of a Class 1 Felony. What do I do?
A Class 1 Felony is a serious offense. Although probation is a potential outcome, if a judge does not give you probation and sentences you to prison, the minimum sentence is 4 years. The maximum sentence is up to 15 years in the Illinois Department of Corrections. However, sentencing on a Class 1 can be as high as 15 years to 30 years if a person is extended range eligible. Therefore, it is a VERY serious case.
What now?
Find the best attorney and hire him or her!
How do I know if he/she is a good attorney?
Speak to the attorney, explain your case, and make sure he or she has a passion for winning. However, if the attorney just wants your money before explaining everything, do not hire that attorney.
Will I go to prison?
A court is required to give you probation unless the facts are so bad that the court simply cannot. A court must also consider mitigation when determining a sentence. Mitigation facts are HERE.
Sentencing Range:
First, probation is an option. However, if a judge is going to sentence you to prison, the range is between 4 years and 30 years.
