What is a Police Report?
A police report is a document that a police officer fills out after he or she arrests a person. It contains information about the person arrested, the victim (if any), and what happened to justify the arrest. These reports are typically typed and are usually one to two pages long. Although I have handled cases where the reports are over a hundred pages.
What is an Arrest Report?
An Arrest Report is the same thing as a Police Report. Police Reports and Arrest Reports are generally referred to as “Discovery.” Learn more about “Discovery” HERE.
How do you get Police Reports, Arrest Reports and Video on a case?
Upon arrest, the police officer writes a Police Report. This report is also known as an Arrest Report. You cannot obtain this report on your own. The police department will not release a copy to you. However, your attorney can obtain these reports and video (if one exists). More information about Police Video is located HERE.
When does my Attorney get the Police Reports, Arrest Reports?
These reports are given to your attorney once your attorney appears in court for you and files his Appearance. An Appearance is a formal notice to the court that the Attorney is going to be responsible for your case. Therefore, your Attorney will get these reports on the first court date.
Should I go to the police station to try to get the Police Report or Arrest Report before I hire an Attorney?
No. The police department will not release these reports to you.
Can I get a copy of the video of my arrest?
If a video exists, a copy will be given to your attorney, and your attorney can provide you a copy. However, the format of the police video is specific, and therefore it will not play on all computers. Additionally, there are certain limitations an Attorney is under in providing copies of Discovery to a Client.
