According to Komonews.com, Omar Medina, age 26, was pulled over because the police thought he might be a drunk driver. When the police asked for his driver’s license, he allegedly responded by offering the police officer a can of beer. Not a good start.
This is an extreme story of what not to do. However, many people do and say things that are just as detrimental to their case.
By saying you are coming from a bar or party and that you were consuming alcohol allows the officer enough justification / evidence to ask you to perform field sobriety tests.
If your going to be serious about not helping the police officer arrest and convict you, then you should simply provide the police officer your driver’s license and insurance. Refusing to answer questions, perform field sobriety tests or submitting to a breath test, will no doubt get you arrested, but it also provides the police officer with little if any evidence to convict you of drunk driving at court.
